JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 11-04-2017 In the matter of cancellation of petitioner's provisional appointment as a Constable in the Central Industrial Security Force, initially, the Selection Committee found that the height of the petitioner was 170 c.m. and he was provisionally appointed, but on

Patna High Court LPA No.1767 of 2016 dt.11-04-2017 2/2 re-assessment of the matter by a Special Committee constituted by the Commandant, it was found that the height was only 167 c.m. He has been erroneously appointed and his appointment has been cancelled.

The writ Court took note of all the aspects, the selection process conducted, review of the selection process and finding that there is no error in the action of the Commandant in directing for a review of height measurement, dismissed the writ petition.

We have heard learned counsel for the parties and we are also satisfied that there is no error in the order passed by the writ Court warranting re-consideration.

Accordingly, finding no merit, the Letters Patent Appeal stands dismissed.
