KUMAR ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned counsel for the Vigilance Department. The Petitioner who is in custody seeks bail in connection with Special Case No. 44 of 2017 arising out of Vigilance P.S. Case No. 58 of 2017 registered for the offence punishable under Sections 8, 7, 13(2) read with 12(1) (d) of the P.C Act, 1988.

The allegation against the petitioner is that he was caught red handed by the Vigilance Department while receiving Rs. 15,000/- as bribe money.

It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. The petitioner has got no criminal antecedent and is in

Patna High Court Cr.Misc. No.44916 of 2017(2) dt.19-09-2017 2/2 custody since, 22.07.2017.

Learned counsel for the Vigilance Department vehemently opposes the prayer of bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-I, Vigilance, Patna in connection with Special Case No. 44 of 2017 arising out of Vigilance P.S. Case No. 58 of 2017.
