The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 472, 120(B) and 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he is owner of the land in question. Further, the original owner of the land was Late Khiran Singh and his grandson namely, Matuk Singh and his sons sold the land in question to the father of the informant Santosh Sen by a registered sale deed on 25.01.1965. It is further alleged that the caretaker of the land informed him that Dilip Kumar Singh got a sale deed executed of the land on 11.11.2020 through a person,
Patna High Court CR. MISC. No.72658 of 2022(4) dt.11-07-2023 2/3 who impersonated Shaktivrato Sen Gupta as son of Late Santosh Sen. Further, the forgery was committed in connivance with the petitioner and Manoj Kumar Singh. It is next alleged that Raj Kumar Gupta and Raju Kumar are witnesses on the sale deed.
The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that petitioner purchased the land in question on the assurance of Dilip Kumar Singh and later, he came to know that the land does not belong to the seller. It is next submitted that petitioner even lost some amount as he had already paid an amount of Rs.12,25,000/- and thereafter, when he came to know that he was cheated an amount of Rs.7,25,000/- was returned to him. It is further submitted that the main allegation hinges around Dilip Kumar Singh.
Learned A.P.P. opposes the bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.72658 of 2022(4) dt.11-07-2023 3/3 satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P. S. Case No.315 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
