This is an application for bail in connection with Fenhara P.S.Case No. 25 of 2017 registered for the offences punishable under Sections 379, 411, 413, 414, 465, 468, 471, 473, 34 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country made pistol and stolen motorcycle. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than five months having no criminal antecedent. Heard learned APP also.

Having heard both sides and in view of the fact that petitioner has no criminal antecedent, let the petitioner, above

Patna High Court Cr.Misc. No.46746 of 2017 (2) dt.11-10-2017 2/2 named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, East Champaran, Motihari, in connection with Fenhara P.S.Case No. 25 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
