JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 323, 341, 386, 435, 379, 34 of the Indian Penal Code, Section 17 of C.L.A. Act and various sections of U.A.P. Act.

Petitioner is named in the first information report but informant says in his written report that culprits had called the name of each others and subsequently, the informant came to know that gang of one Kundan Ji committed the present occurrence and petitioner was one of the members of aforesaid gang.

Petitioner does have criminal antecedent of three

Patna High Court Cr.Misc. No.42501 of 2016 (2) dt.05-10-2016 2/2 cases but submission on behalf of the petitioner is that having similar allegation, some co-accused have already been granted privilege of bail by this Court as well as by another Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Gaya in connection with Belaganj P.S. Case No. 138 of 2016.
