Petitioner is in custody in connection with Tarabari P.S. Case No. 85 of 2019 for the offence under section 379 of the Indian Penal Code.

Learned counsel for the petitioner would submit that allegation against this petitioner is that he was involved in theft of motorcycle. He submits that name of the petitioner surfaced during the course of investigation. He was not named in the FIR.

Learned counsel for the petitioner submits that petitioner is in custody since 17.6.2019.

Considering the fact that petitioner was not named in the FIR, the Court is inclined to grant bail to the petitioner, let
