2. The petitioner has preferred this application for grant of regular bail in connection with Kudra P.S. Case No. 273 of 2025 dated 15.06.2025 registered for the offences punishable u/ss 109(1) read with 3(5) of the B.N.S.
3. As per the prosecution case, when the informant alongwith her husband was going to railway station to catch Bhabhua Patna intercity to attend her duty, then two persons riding on a motorcycle came and shot the informant on left side of his back due to which she got injured. It is further alleged that due to the unpaid debt of Rs. 65,000/-, one Ajay Paswan alongwith his associate shot the informant with an intention to kill her.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.63106 of 2025(2) dt.24-09-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused person namely, Amit Kumar @ Raja Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concerned with the said incident as he do not know the informant and the person who shot her. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Kaimur at Bhabhua in connection with Kudra P.S. Case No. 273 of 2025, subject to the following condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.63106 of 2025(2) dt.24-09-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
