The petitioner is in custody since 12.05.2017 in connection with Bihpur P.S. Case No. 136 of 2015 for the offence registered under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner has been brought in only on the basis of suspicion. It is further submitted that the petitioner has been implicated in this case due to dirty village politics. There is no eye witness to the occurrence.

Considering the aforesaid facts and circumstances of the case and that the petitioner has got no criminal antecedent, let

No.46364 of 2017 (2) dt.22-09-2017 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 136 of 2015, subject to the following conditions :- (i) one of the bailors will be his own relative, namely, father, mother, brother, Sister and/or his wife.

(ii) (ii) the petitioner shall present himself before the Court below on each and every date of the trial and shall not absent himself from the trial for any reasons whatsoever without taking permission of the Court.
