The petitioner, who is in custody since 16.7.2016 in Rail Sonepur (Hazipur ) P.S. Case No. 59 of 2016 registered for the offence under Section 47 of the Bihar Excise Act, 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and this fact has been stated in paragraph no. 3 of the petition. He further submits that on false accusation of recovery of huge quantity of Indian make foreign liquor petitioner has been arrested. Sri R.B. Rai Raman, learned Additional Public Prosecutor has opposed the prayer. He submits that huge quantity

Patna High Court Cr.Misc. No.40641 of 2016 (2) dt.04-10-2016 2/2 of foreign liquor was recovered.

However, keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner Prashant Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur / concerned court in connection with Rail Sonepur (Hazipur ) P.S. Case No. 59 of 2016.
