The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code.
As per the prosecution case, this petitioner in connivance with other co-accused persons embezzled the government money.
It is submitted that petitioner has been falsely implicated in this case due to village politics. At the relevant time, petitioner was Panchayat Sachiv of Karhara Panchayat and discharged his duty with full attention and honesty. It is next submitted that on this issue a report was submitted by the Block
Patna High Court CR. MISC. No.65675 of 2022(4) dt.05-05-2023 2/2 Panchayat Raj Officer-cum-Executive Officer stating therein that work has already been completed. The SDPO, Banka in his supervision report also asserted the fact that the work has already been completed. Petitioner claim clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Barahat P.S. Case No. 183 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
