====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 30-06-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 376, 379, 420, 493, 34 of the Indian Penal Code.

3. The present matter had been sent before the Patna High Court Mediation Centre for reaching an amicable settlement between the parties as the matter related to a love affair between the parties and a false promise of marriage. The report received from the Mediation Centre indicates that the parties have finally settled their issues by way of a Memorandum of Agreement dated 18.06.2025 passed in Mediation Proceeding No. 396 of 2025 and the parties are expected to strictly adhere to the terms

Patna High Court CR. MISC. No.67373 of 2024(5) dt.30-06-2025 2/2 and conditions of the settlement as indicated in the said agreement.

4. Learned counsel appearing for the informant also supports the Memorandum of Agreement.

5. Considering the entire facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Rautara P.S. Case No. 95 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.

6. Taking into consideration the fact that the petitioner has performed his part of the obligation, both the parties are directed to fulfill the terms especially indicated in paragraphs 6 & 7 of the said agreement.
