Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, the name of the petitioner surfaced in the statement of injured Chamak Lal Mandal and Prem Shankar who are said to have sustained injuries in the present occurrence. Learned counsel for the petitioner submits that the petitioner is in jail custody since 21.11.2015 and no specific overt-act has been attributed against the petitioner. It is further submitted that moreover, except injury report of injured Atardeo Roy, I.O did not collect any injury report of other injured of this case.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the

No.40440 of 2016 (3) dt.19-11-2016 petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge III, Bhagalpur in Sessions Trial no. 182/2016 arising out of Nathnagar P.S. Case no. 237/2015.
