The petitioners, being the parents and brother of the husband of the informant are languishing in custody since 06.07.2019 in a case registered for the offences punishable under Sections 304B and 201/34 of the IPC.

The accusation against the petitioners and other co-accused persons is of killing the sister of the informant, Renu Devi within four years of the marriage by administering poison and disposing her dead body.

It is submitted by learned counsel for the petitioners that the accusation against the petitioners is omnibus and general. It

No.62549 of 2019(2) dt.25-10-2019 2/2 is further submitted that the thrust of accusation is against the husband of the victim and the petitioners claim to live separate from the husband of the victim. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the petitioners are named in the FIR with specific accusation.

Considering the thrust of accusation against the husband of the victim and the period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Sandesh P.S. Case No. 18 of 2014. Since the FIR was registered in the year 2014 and the petitioners surrendered in the year 2019, learned Court below will be at liberty to cancel the bail bonds of the petitioners, if they default for three consecutive occasions.
