JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-08-2018 On 25.08.2018 when the case was called out no one appeared on behalf of the petitioner to press this application, yesterday a pass over was sought in the matter which was allowed but today again no one is appearing on behalf of petitioner to press this application.

Learned counsel representing the Central Government submits that in terms of the order of the learned writ court several letters had been sent to the petitioner calling upon him to appear before the Passport Officer with the relevant documents, so that his representation may be considered. A statement has been made in the show cause filed

Patna High Court MJC No.3285 of 2016 (5) dt.28-08-2018 on behalf of opposite party no. 2 that the letter sent to him returned undelivered with endorsement of postal peon "No persons was found at the given address." The petitioner has not turned up with the relevant documents which is delaying the disposal of his representation.

Taking note of the fact that nobody is appearing for the petitioner for last two days to press this application and a reason has been shown to this Court in the show cause filed on behalf of opposite party no. 2 as to why the representation of the petitioner could not be disposed off till now, in the opinion of this Court no case for initiation of contempt is made out. The petitioner should visit the office of the Passport Officer and produce the relevant documents in order to ensure that appropriate order be passed by the Passport Officer as per direction of the learned writ court.
