JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Supaul P.S. Case No. 162 of 2015 registered under Sections 147, 148, 323, 325, 379, 427, 504 and 506 of the Indian Penal Code.

The accusation is that a dinner party was organized at the farm house of informant, Mithelesh Kumar Thakur, where nine accused persons including the petitioners and others came there and assaulted the son of informant through the butt of pistol and snatched the gold chain from the neck of the informant.

Patna High Court Cr.Misc. No.43560 of 2015 (2) dt.14-10-2015 Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to ulterior motive and have no criminal antecedent. It is further submitted that co-accused, Rajnish Kumar Singh, has already been granted privilege of anticipatory bail by a Bench of this Court vide order dated 24.09.2015 passed in Criminal Misc. No. 38172 of 2015. Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No.

162 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Out of two sureties, one surety must be the close relative of the petitioners, who will file an affidavit showing their relation with the petitioners.
