The petitioner apprehends his arrest in Fatehpur P.S. Case No. 49/2015, registered for the offences punishable under Section 302 and other sections of the Indian Penal Code. The informant named the petitioner and other accused persons and alleged that they all assaulted his father and committed murder and threw his dead-body in the well. Some dispute arose for taking water from the well. Learned counsel for the petitioner submits that there is omnibus and general allegation of assault against the petitioner and other accused persons. There is admitted enmity, but it appears from perusal of the post-mortem report and case diary that petitioner and other accused persons are alleged to have assaulted

Patna High Court Cr.Misc. No.41379 of 2016 (3) dt.06-12-2016 2/2 the father of the informant. As many as three injuries were found on the body of the deceased and the injuries are fatal. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
