2. The petitioner has preferred this application for grant of regular bail in connection with Salkhua P.S. Case No. 209 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(2), 109, 74, 351(2), 352 and 3(5) of the BNS.

3. As per the prosecution story, the informant has alleged that on 07.09.2024, when the informant was fixing shuttering to cast roof, in the meantime, all the F.I.R. named accused persons including this petitioner objected and assaulted the informant by means of lathi.

4. Learned counsel for the petitioner submits that the petitioner and the informant are next door neighbours and there is case and counter case due to land dispute between the parties.

Learned counsel further submits that other co-accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 06.08.2025 in Cr. Misc. No. 44081 of 2025, copy of the order sheet is annexed in bail petition as Annexure-P/7. The petitioner is in custody since 28.06.2025 having no criminal antecedent.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Salkhua P.S. Case No. 209 of 2024.
