2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of Bharatiya Nyaya Sanhita.
3. The case of the prosecution is that the petitioner along with 10 others went near the field of the informant. It is further alleged that Ravi Ranjan Kumar assaulted with butt of country made pistol to the father of the informant and Anuk Rai and Manoj Rai both assaulted with knife on the neck and cheek due to which the father of the informant succumbed to the injuries.
4. Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that the petitioner is
Patna High Court CR. MISC. No.62918 of 2025(2) dt.10-09-2025 2/2 only a member of the mob. No specific overt act is attributed to him. The nature of allegation against the petitioner is general and omnibus. The petitioner is a man of clean antecedent and is in judicial custody since 07.05.2025.
5. Learned Additional Public Prosecutor for the State has conceded that there is no specific allegation against this petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Athmalgola P.S. Case No. 150 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Barh, Patna. (Ashok Kumar Pandey, J) durgesh/- U T
