2. In the present case, the petitioner seeks bail in a case registered for the offences under Sections 328, 302, 120 ( B ) and 34 of the Indian Penal Code .

3 . As per the prosecution case , informant namely , Mukesh Kumar singh alleged that his brother who was in custody in Motihari Jail was remanded in Aalind Rai murder case in Bettiah Jail, wherein Jailor, Jail Superintendent and doctor of the jail killed brother of informant by administering poison to him.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not named in the F.I.R.

Patna High Court CR. MISC. No.64387 of 2025(3) dt.03-11-2025 2/2 The name of the petitioner surfaced during investigation as he was also a prisoner with the deceased in the same jail. Only suspicion has been raised against this petitioner. No specific allegation is attributed against him. Petitioner was not seen administering poison to the victim. Petitioner is in custody since 10.02.2025 .

5 . Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Considering the fact that petitioner is not named in the F.I.R., and also considering the fact that no specific allegation is against petitioner and further considering the period of custody and his clean antecedent, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge X, West Champaran in connection with Bettiah P.S. Case No. 313 of 2012.
