JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2022 The present writ petition has been filed seeking the following reliefs:- "1. That the petitioner craves indulgence of this Hon'ble Court for issuance of an appropriate writ in the nature of mandamus or any other writ/ writs, order/ orders, direction/ directions, command/commands directing the respondents to not construct the road over the Khatiyani land of the petitioner appertaining to R.S. Khata No. 03, R.S. Plot No. 405, Khata No. 44, Plot No. 404 and 406 situated at Mauza-Koni, P.S.

Dinara, District-Rohtas without initiating a

Patna High Court CWJC No.7336 of 2018(3) dt.01-08-2022 2/2 proceeding under the provisions of Bihar Bihar Land Acquisition Act and further to pass an order directing the respondents to remove the encroachment made by respondent no. 6 and 7 from Khata No. 60, Plot No. 403 area 6 decimals situated at Mauja Koni, P.S. Dinara, District-Rohtas which is a public land and further to give possession of the petitioner over which new Rasta has been created i.e. Khata No. 3, Plot No. 405, Khata No. 44, Plot No. 404 and 406 situated at Mauza-Koni, P.S. Dinara, District-Rohtas."

After some argument, the learned counsel for the petitioner seeks to approach the District Magistrate, Rohtas at Sasaram for redressal of his grievances as aforesaid. Liberty so sought is granted.

The writ petition stands disposed off.
