JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120B, 379, 386 & other minor sections of the Indian Penal Code.
Petitioner is named in the first information report but the informant expressed her suspicion against the petitioner and several other persons on the basis of different grounds. The informant claims that the petitioner and one Kali Yadav had demanded extortion money from her husband whereas; some other FIR named accused had previous dispute and enmity with husband of the informant.
However, in course of investigation on 15-03-2015,
Patna High Court Cr.Misc. No.42454 of 2016 (6) dt.05-12-2016 2/2 one witness namely Babulal Yadav vide paragraph-4 of supplementary case diary, claims that he had seen the petitioner and one Kali Yadav taking away the deceased towards the forest. It appears that except the aforesaid material as well as criminal antecedent, there is nothing against the petitioner. Moreover, having more or less similar allegation, some coaccused have already been granted privilege of bail by this court. The investigation against the petitioner has already been completed and except the aforesaid material, nothing has come against the petitioner.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jhajha P.S. Case No. 36 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui. (Hemant Kumar Srivastava, J) A.K.V./- U T
