JUSTICE RAKESH KUMAR ORAL ORDER 08-12-2016 Heard Sri Sanjay Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody since 2.8.2016 in Bhagwanpur P.S. Case No. 134 of 2016 registered for the offence under Sections 341, 323, 307, 504/ 34 of the Indian Penal Code has prayed for grant of bail.

By way of referring to the F.I.R. learned counsel for the petitioner submits that in a land dispute a trivial occurrence had taken place however color of seriousness of offence was given and F.I.R. was lodged for the offence under Section 307 of the Indian Penal Code. It has been argued that petitioner is having clean antecedent and this fact has been stated in paragraph no. 3 of the petition.

Considering the nature of accusation, clean antecedent of the petitioner and period of custody , let the petitioner Rajeev Choudhary @ Sanjeet Choudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai / concerned court in connection with Bhagwanpur P.S. Case No. 134 of 2016.
