JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.12.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under section 379, 308 and other minor sections of the Indian Penal Code.

There is case and counter case between the parties and persons from both sides sustained injuries. No doubt, there is allegation against the petitioner that he along with others assaulted the informant and some others as a result whereof five persons sustained injuries but the impugned order of learned Sessions Judge goes to show that all injured sustained simple injuries said to be caused by hard and blunt substance.

Moreover, having more or less similar allegation coaccused Arjun Singh and Rajesh Kumar Singh @ Rajesh Singh

Patna High Court Cr.Misc. No.44795 of 2016 (2) dt.06-12-2016 have already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 06.10.2016 passed in Cr. Misc. no.39035/2016 and, therefore, in the aforesaid circumstance, with an intent to maintain parity, I have no option but to extend the privilege of anticipatory bail to the petitioner.

Accordingly, this anticipatory bail is allowed and it is ordered that, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Raghubar Prasad Om, Judicial Magistrate, Ist Class, Bhojpur at Ara/ concerned court in Tiyar P.S. Case no. 15/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
