The petitioner seeks regular bail in connection with Barachati P.S.Case no.69 of 2012 registered for offences punishable under Sections 395 and 397 of the Indian Penal Code. The case is under Section 395 and 397 of the Indian Penal Code.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, he is not named in the FIR and nothing has been recovered from his possession as well as except confession there is nothing against him. The petitioner is accused in three other cases also but another coaccused has already been granted bail by this Court, vide order dated 5.9.2017 passed in cr. Misc. No.40631 of 2017. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.46903 of 2017 (3) dt.17-10-2017 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Barachati, District Gaya in connection with Barachatti P.S.Case No.69 of 2012 dated 23.02.2017.
With following conditions :
(i) One of the bailors of the petitioner shall be local person having sufficient immovable property within the jurisdiction of concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidences.
(iii) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court concerned and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, his bail bond shall be cancelled.
(iv) Further condition that till conclusion of the trial of this case, he will make his attendance before the concerned Police Station of the area in the first week of every month so that the police may watch his conduct, otherwise, his bail bond shall be cancelled.
A copy of the order be communicated to the S.P., Gaya.
With the aforesaid observation, this application is allowed.
