2. Having regard to the nature of the prayer, the interlocutory application is allowed and the same shall be treated as forming part of the writ petition.

3. The main writ petition has been filed for quashing the order dated 13.07.2015 passed in R. P. No. 31/2017.

4. Learned counsel for the petitioner submits that during the pendency of the writ petition, Appeal No. 49 of 2017/55/45 in Claim Petition - O.A. No. 1056 of 1999 has since been decided by the Debts Recovery Appellate Tribunal at Kolkata by which liability of the petitioner, who happens to be the Guarantor for the land in question, was confined to Rs. 8,50,000/- only jointly and severally with other respondents. To that extent, the impugned order of the Debts Recovery Tribunal had been modified.

5. Learned counsel for the respondents appears and has been heard. A counter affidavit has been filed and placed on record. The stand of the petitioner with regard to the final order passed by the Debts Recovery Appellate Tribunal as aforesaid has not been controverted.

6. In the above view of the matter, the writ petition is disposed of with liberty to the petitioner to approach the Recovery
