2. The petitioner seeks regular bail in connection with Kanti P.S. Case No. 139 of 2023, lodged on 20.02.2023, under Section 401 of the Indian Penal Code and under Sections 25(1b)A/26/35 of the Arms Act.

3. As per the prosecution case, the FIR has been filed against four named accused persons including the petitioner. Allegation in the FIR is that all accused persons have been apprehended by the police during secret information by the patrolling party and from the petitioner's possession 9 MM pistol and two live cartridges have been recovered.

4. It transpires from the application that the petitioner

Patna High Court CR. MISC. No.68056 of 2023(2) dt.18-10-2023 2/2 is in custody since 21.02.2023. There are six criminal cases pending against the petitioner.

5. Learned counsel for the State opposes the prayer for bail and submits that at the time of consideration of bail this aspect has been taken into consideration that petitioner has criminal antecedents.

6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner and this bail application is rejected but liberty is granted to the petitioner that he may renew his prayer for bail three months after framing of the charges.
