The petitioner is languishing in custody in a case registered for the offences punishable under Sections 25(1-B) a, 26(i)(ii), 35 of the Arms Act and Sections 8, 20(b)(ii)(b) of the N.D.P.S Act.
There is recovery of one country made pistol, five live cartridges and 1.5 Kgs of Ganja from the house of the petitioner.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner has no concern with the seized illicit arms or the contraband. Moreover, similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 07.07.2023 passed in Cr. Misc. No. 38328 of 2023. The petitioner is languishing in custody since 11.03.2023. A statement has been made in para 3 of the petition that petitioner is accused in five other cases apart from the present one.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is accused in five other cases of similar nature apart from the present one.
Considering the fact that petitioner is accused in five other cases apart from the present one, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for bail of the petitioner stands rejected.
