JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 24-05-2016 Petitioner wants a direction upon the respondents to entertain his request for district transfer from Supaul to Samastipur on the basis of his application filed before the authorities in terms of Annexure-3.

According to the petitioner, his application was filed as per the decision of the Director, Primary Education, contained in Annexure-2.

The State in the counter affidavit has taken two objections; one that identical issue has already been heard and dismissed by the High Court in C.W.J.C. No.13966 of 2013, decided on 18.03.2014 and that yet another letter has been issued by the Director, Primary Education, on 23.11.2015, which is

Patna High Court CWJC No.15313 of 2015 (2) dt.24-05-2016 2/2 Annexure-A to the counter affidavit with regard to the status of such transfer.

Reading of the decision of the learned Single Judge in conjunct with Annexure-A, no relief can be granted to the petitioner.

Writ application is dismissed.
