The petitioners apprehend their arrest in connection with Nagar P.S. Case No.620 of 2016 registered under Sections 341, 323, 448, 307 and 504/34 of the Indian Penal Code. The accusation is that on 01.11.2016 at about 06.00 P.M. in evening, the petitioners came at the door of the informant and started to abuse due to drainage of the dirty water. On hearing 'hulla', when the wife and daughter of the informant, came out of the house, Manoj Kumar armed with Khanti came and caused head injury at the daughter of the informant through Khanti.
Patna High Court Cr.Misc. No.46541 of 2017 (2) dt.22-09-2017 2/2 Learned counsel appearing on behalf of the petitioners submits that the only allegation against the petitioners is of abusing the informant due to drainage of the dirty water. The specific allegation to cause injury at the head of the daughter of the informant with Khanti is against Manoj Kumar. Moreover, two injuries, as found on the person of the daughter of the informant, are simple in nature.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nagar P.S. Case No.620 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
