The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 354B, 376/511, 323, 504, 307/34 of the Indian Penal Code, 27 of the Arms Act, 3(1)(xi) of SC/ST (Prevention

Patna High Court Cr.Misc. No.44599 of 2015 (2) dt.29-10-2015 2/3 of Atrocities) Act and 8 of The Protection of Children from Sexual Offences Act.

It is alleged that the accused persons attempted to outrage the modesty of the daughter of the informant and abused by calling caste name. It is also alleged that petitioner nos. 2 and 5 resorted to fire when the informants, nephew, daughter and son were also assaulted by the accused persons.

It is submitted by learned counsel for the petitioners that except one injury of Ganga Ram all injuries have been found to be simple and the accusation has been maliciously levelled since the petitioners' side filed Encroachment Case No. 04/15-16 against the informant side at earlier point of time. It is submitted by learned counsel for the informant that the accusation is specific against the petitioners and they have also caused grievous injury.

Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bhabua P.S. Case No. 424 of 2015 pending in the court of learned Chief Judicial Magistrate,

Patna High Court Cr.Misc. No.44599 of 2015 (2) dt.29-10-2015 3/3 Kaimur at Bhabua.

With the aforesaid observation, this application is disposed of.
