JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and 47a of the Excise Act.

Fifty seven pieces of pouch, containing 200 ml. country-made liquor each, are said to have been seized by the informant while the aforesaid pouches were being carried by the petitioner and one other person, who managed to escape from there.

Submission on behalf of petitioner is that one unknown person had taken lift on the motorcycle of the petitioner and the aforesaid unknown person was carrying sachet in his hand but

No.44733 of 2016 (2) dt.18-10-2016 2/2 seeing the police party, the aforesaid person fled away from there, leaving behind the aforesaid sachet and unfortunately, the petitioner was caught on the spot. It is further submitted that the petitioner does not have any criminal antecedent and is languishing in jail custody since 10-08-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Turkaulia P.S. Case No. 351 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
