JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Mirganj Police Station Case No. 182 of 2016 registered for the offences punishable under Sections 147, 341, 323, 324, 308, 379, 504 of the Indian Penal Code.
Petitioner no. 2 is said to have assaulted the informant by means of dagger causing injury on his hands whereas petitioner no. 1 is said to have pressed the neck of maternal grand son of the informant with an intent to commit his murder. Submission on behalf of the petitioners is that the
Patna High Court Cr.Misc. No.45014 of 2016 (2) dt.15-12-2016 2/2 alleged occurrence appears to have taken place on account of land dispute and the informant sustained four injuries but all injuries were found simple in nature. It is further submitted that so far as the incised wounds are concerned, as a matter of fact, the informant himself got manufactured the aforesaid injuries so that he could implicate the petitioners in a false case. It is further submitted that so far as another injured is concerned, there is no injury report to show that the said injured sustained injury.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Mirganj Police Station Case no. 182 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
