Petitioner is languishing in judicial custody since 18.05.2017 in connection with Turkaulia P.S.Case No.269/17 for the offences under Sections 363, 366 (A) and 120(B)/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his niece Shilpi Kumari aged 17 years had been kidnapped by the petitioner along with three others and still she is traceless. It has been submitted by the learned counsel for the petitioner that he is the father of the boy, Pradeep Kumar with whom the niece of the informant had eloped and both have married as husband and wife. Because the petitioner is father of
Patna High Court Cr.Misc. No.47170 of 2017 (3) dt.28-11-2017 2/2 Pradeep Kumar, he has been made accused in the present case. He submits that charge sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner.
However, learned A.P.P. opposed the prayer for bail. Considering the facts and circumstances and the materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran at Motihari, in Turkaulia P.S.Case No.269 of 2017 subject to the condition that both bailors of the petitioner shall be his close relatives.
