JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 17.06.2016 in a case registered under sections 304B, 201/34 of the Indian Penal Code. The informant states in her written report that the marriage of the deceased had taken place with the petitioner on 24.05.2013 and according to the informant herself, deceased was killed on 15.09.2015. The informant has admitted in his written report that deceased led her married life happily and peacefully with the petitioner for near about one year and after one year of the marriage, the informant claims that the demand of gold and motorcycle was made.

Patna High Court Cr.Misc. No.44420 of 2016 (3) dt.28-11-2016 2/2 Submission on behalf of the petitioner is that the deceased was a short tempered lady and, as a matter of fact, a petty family feud had taken place and in anger, deceased consumed poison. It is further submitted that while deceased was taken to hospital, she died on the way and in presence of informant, the dead body of the deceased was cremated. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Saharsa in connection with Nauhatta P.S.Case No. 200 of 2015.
