ANJANA MISHRA ORAL ORDER 01-10-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 02.08.2019 in connection with Muffasil P.S. Case No.177 of 2019/G.R. No.883/2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of the present petitioners. So far as the criminal antecedents of petitioner no.1 is concerned, he is involved in one other case under Sections 341, 323, 308/34 of the Indian Penal Code, in which he is on bail. Considering the aforementioned facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the court of learned Additional Sessions Judge-VII-Cum-Special Judge (Excise), Aurangabad, in connection with Muffasil P.S. Case No.177 of 2019/G.R. No.883/2019.
