Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 354, 379, 427, 504, 506/34 of the Indian Penal Code.

Both sides are agnates. Civil suit for partition of the joint family property was also going on though preliminary decree in the suit has already been passed. In the aforesaid background, allegation is that the petitioner and others were ploughing the field allotted to the share of the informant, who is an advocate, and when informant and others forbade them they allegedly committed abuse and assault and theft of gold chain and attempted to outrage the modesty of the female members of the informant, who was

Learned counsel for the informant opposed the prayer for bail.

Considering the background and nature of allegation, let the petitioner, above named, who is aged about 70 years, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barauli Police Station Case No.172 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
