JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-12-2018 After some argument, the learned counsel for the petitioner seeks to withdraw the present writ petition with liberty to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914.
Accordingly, the writ petition is disposed of as withdrawn with liberty to file objection under Section 9 of the Act before the District Certificate Officer, Kishanganj in connection with Certificate Case No. 17 of 2014-15 within a period of four weeks from today which shall be considered by the District Certificate Officer, Kishanganj and final orders under Section 10 of the Act shall be passed.
Patna High Court CWJC No.16791 of 2016(2) dt.17-12-2018 2/2 Till the passing of the final order, no coercive steps shall be taken against the petitioner.
It is needless to state that in case no objection is filed by the petitioner under Section 9 of the Act, within a period of four weeks from today, the District Certificate Officer, Kishanganj shall proceed ex parte.
