It appears that the petitioner was transferred and posted at Bir Nagar Branch in Araria Region of Uttar Bihar Gramin Bank. On certain grounds including the alleged attack on him by miscreants, he made a representation for his transfer to any place nearby Purnia or in Purnia. Thereafter, the petitioner went on leave and has even stated that he will remain on leave till such representation is

Patna High Court CWJC No.17254 of 2016 dt.13-02-2017 2 / 2 considered. It is informed by the learned counsel for the Bank that, considering the same to be indiscipline and misconduct on the part of the petitioner, a disciplinary proceeding has already been initiated against the petitioner.

In above view of the matter, this writ application stands disposed of with a direction to the petitioner to first join at Bir Nagar Branch in Araria and then let the representation for his transfer to some other place be considered by the Bank authority expeditiously preferably within a period of four weeks in accordance with law. It is made clear that this Court has not said anything regarding the disciplinary proceeding which is pending against the petitioner as the learned counsel for the petitioner himself has not pressed that at the time of hearing.
