The petitioner is in custody since 04.07.2019 in connection with Sadar P.S. Case No.428/2019 for the offence punishable under Sections 341,307,379 and 34 of the IPC and 27 Arms Act.

Learned counsel for the petitioner submits that from bare perusal of the FIR it can be well assessed that the petitioner has no role of play in the occurrence and it is only on the basis of suspicion that the petitioner has no hand behind the occurrence, yet he has been taken into custody. Admittedly, there is dispute within the family and the petitioner is own first cousin of the informant.

Considering the aforementioned facts and

No.59273 of 2019(2) dt.19-09-2019 2/2 circumstances of the case and that admittedly petitioner has not participated in the occurrence, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Sadar P.S.
