Mr. Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 160 of 2019, registered for the offences punishable under Sections 302/34 of IPC.

As per F.I.R. the son of the informant left the house, but did not return back in the night and a search was conducted and thereafter, his dead body was found lying behind Style Bazar boundary of Janta Cement Store. Petitioner is not named in the F.I.R., later on, his name transpires on the confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him and he is in custody since 26.06.2019. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that it is the case of planned

No.59481 of 2019(3) dt.20-11-2019 2/2 murder, as earlier the petitioner, deceased and other accused persons were involved in a dacoity and dispute with respect to distribution of the amount between them, due to that, the accused persons killed the son of the informant. Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

With the above observations, this application is dismissed.
