The petitioner seeks bail in connection with Amnor P.S. Case no. 1 of 2014 registered for the offence punishable under Sections 147, 148, 149, 427 and 436 of the Indian Penal Code and 17 of the CLA Act.

The petitioner along with 15 accused persons are said to have torched the JCB machine and bolero vehicle of the construction company.

It is submitted by the learned counsel for the petitioner that during the investigation, not a single witness has identified the petitioner. The informant simply stated that criminals were talking to each other by name including that of the

Patna High Court Cr.Misc. No.45992 of 2017 (2) dt.20-09-2017 petitioner. The allegation levelled against the petitioner is not specific rather omnibus. Similarly situated co-accused persons namely, Rambabu Paswan and Chandan Jee have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 16.01.2015 passed in Cr. Misc. no. 34825 of 2014. The petitioner has been languishing in custody since 17.11.2016. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Session Judge 11th, Saran at Chhapra in connection with Amnor P.S. Case No. 1 of 2014.
