JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
The prosecution case as per F.I.R is that the houses of the informant and the other people of the vicinity were robbed by the miscreants. It is alleged against the petitioner that he was apprehended by the villagers and from his possession cash of Rs. 29,000/- was recovered.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.63344 of 2022(2) dt.21-02-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. The cash recovered from the petitioner is his own money and except cash, no other material has been recovered from the petitioner. The petitioner is languishing in custody since 31.05.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran in connection with Shrinagar P.S. Case No. 73 of 2022, arising out of G.R. Case No. 2346/2022.
