Statement of the victim girl under section 164 Cr.P.C. is annexure-2 to this application which clearly shows that the victim girl had eloped with one Syed Zafar Eqbal and had married at Gajiyabad. In her statement she has clearly stated that she wants to live with her husband in her Sasural. Her age has been determined medically at about 17 and half years and admittedly she is a Muslim.

Chaudhary, learned Judicial Magistrate ist Class, East Champaran, at Motihari in Kesariya P.S. Case No. 292 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
