Learned counsel for the State has filed a counter affidavit wherein it has been brought on record vide Annexure 'A' that the case of the petitioner was duly considered and by means of a reasoned order, the same has been rejected. Learned counsel for the petitioner thus submits that the same constitutes a fresh cause of action and, therefore, seeks liberty to withdraw the present writ application with a fresh liberty to file any other appropriate proceeding which may be available to the petitioner in accordance with law.
