JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-10-2017 The appellant seeks regular bail in connection with Barauni Chakia P.S. Case No. 204 of 2017, registered for offences punishable under Sections 354(B), 376 and 511 of the Indian Penal Code and section 3(i)(xi) of SC/ST Act and Section 8 of POCSO Act.
Allegation against the appellant is of trying to commit rape on the daughter of the informant and also tried to kill her. It has been submitted on behalf of the appellant that there was altercation between the appellant and informant and appellant had gone to lodge a case against the informant but he has been arrested and falsely been implicated in this case and no such occurrence has ever taken place and he has been in judicial custody since 10.06.2017.
Patna High Court CR. APP (SJ) No.2684 of 2017 (3) dt.13-10-2017 2/2 Learned Special P.P. opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and serious nature of allegation, I am not inclined to release the appellant on bail, this appeal is, accordingly, dismissed.
However, the trial court/special court is directed to expedite the trial and try to conclude it within a reasonable period of time preferably within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
