Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 409, 420 and 120B of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent. It is next submitted that petitioners, being Chairman and Secretary of the Committee, have been falsely implicated in the present case. It is next submitted that from perusal of the counter-affidavit filed on behalf of the District Magistrate, it would manifest that the same at Para-8 records that the petitioners have completed the

Patna High Court CR. MISC. No.67459 of 2023(5) dt.11-03-2024 2/2 work of an amount of Rs. 29,43,409/- and work left now is worth Rs. 76,090.29/-. It is further submitted that at times it takes time to complete the work.

The learned APP appearing on behalf of the State does not dispute the said submission of the learned counsel for the petitioners that work worth Rs. 29,43,409/- has been completed.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kateya P.S. Case No. 21 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
