JUSTICE PRABHAT KUMAR JHA ORAL ORDER 05-12-2016 Learned counsel for the petitioner is permitted to make correction in the name and designation of the court in which the case is pending in para 1 and prayer portion of the bail petition. Heard both sides.

The petitioner apprehends his arrest in Gamharia P.S. Case No. 87/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The Circle Officer, Gamharia made allegation that on 06.06.2016 the defeated candidates of Mukhia and other defeated candidates of different post of panchayat and about 5000 supporters assembled in the premises of the block and asked the Circle Officer to hold re-election on all the posts and ransacked the Circle office, also damaged the public property.

Patna High Court Cr.Misc. No.45968 of 2016 (3) dt.05-12-2016 2/2 It is submitted that 112 persons including the petitioner are named in the F.I.R., but no specific allegation is made. It is submitted that petitioner along with others were peacefully making protest, but false case has been lodged against them.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Madhepura in connection with Gamharia P.S. Case No. 87/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
