The petitioner seeks regular bail in connection with NDPS Case No. 24 of 2019 arising out of Pipra P.S. Case No. 224 of 2018, registered for the offence punishable under Sections 414, 420 of the Indian Penal Code and Sections 20, 22 of the NDPS Act.

The allegation is regarding recovery of 500 grams each of charas from two vehicles totalling to recovery of one kg. charas whereupon the co-accused persons were arrested from the spot and they had disclosed that the petitioner had loaded charas in the vehicle after unloading wine. The learned counsel for the petitioner has submitted that the co-accused persons, who were arrested from the spot,

Patna High Court CR. MISC. No.60868 of 2019(3) dt.16-11-2019 2/2 have already been granted bail by coordinate Benches of this Court vide orders dated 11.1.2019, 14.2.2019 and 14.3.2019 passed in Criminal Miscellaneous Nos. 70976 of 2018, 78009 of 2018 and 71682 of 2018. It is further submitted that the petitioner has been falsely implicated in the present case and he is languishing in custody since 30.5.2019.

Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge / Special Judge, East Champaran, Motihari in connection with NDPS Case No. 24 of 2019 arising out of Pipra P.S. Case No. 224 of 2018.
