The petitioner is in custody since 07.08.2019 in connection with Ghoghardiha P.S. Case No. 103 of 2019 for the offence registered under Sections 272, 273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Excise (Prohibition) Amendment Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the Pan Dukan which is being frequented by many persons.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
