The petitioner apprehends his arrest in Chowk P.S. case No. 97 of 2017 for the offences punishable under Section 307, 354(A) and other Sections of the Indian Penal Code. The informant named the petitioner along with his three sons and alleged that Sanni Kumar and Aman Kumar caught her hand and started dragging her. The informant raised alarm. On such, her father and younger brother, Asimanand, came but the accused persons assaulted her.
The learned counsel for the petitioner submits that petitioner is father of Sanni Kumar. The informant solemnized marriage with Sanni Kumar on 14.08.2015 before the Registrar. The informant lived with her husband for some time but thereafter some dispute arose between the two sides as both of them belong to different caste. It is submitted that father of informant lodged
Patna High Court Cr.Misc. No.46831 of 2017 (2) dt.09-11-2017 2/2 Chowk P.S. case No. 104 of 2016 under Section 385, 385 and other Sections of the IPC in which the petitioner has already been granted anticipatory bail. The informant also lodged Chowk P.S. case No. 43 of 2016 against Sanni Kumar and others. It appears that informant made allegation against Sanni Kumar and Aman Kumar. Petitioner is father of Sanni Kumar and Aman Kumar. The informant earlier solemnized marriage with Sanni Kumar (Annexure-2).
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sushant Ranjan, learned Judicial Magistrate, 1st class, Patna City, Patna in connection with Chowk P.S. case No. 97 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
